LIABILITY WAIVER AND RELEASE. The Student/Customer (Student) understands and agrees that strict observation of Allied MMA’s (Allied) rules and the rules relative to the service or instruction provided, including the use of protective equipment is required. The Student understands and agrees that the use of Allied’s facilities and the Student's presence at Allied’s facility are at the sole risk of the Student.
The Student understands and agrees that the services or instruction provided may involve skills and training which include violent and sudden movements and that, in connection with the training, there will be physical contact between instructors and Students and between and among the Students. Such contact may result in personal injury to the Student, despite precautions taken to avoid such injuries. Student hereby consents to engage in such contact as may be necessary or required by Student's participation.
The Student, on behalf of themself and anyone claiming by or through the Student, hereby holds harmless, releases, and forever discharges Allied MMA and its instructors and authorized representatives from any liability, claim, loss, including loss of property, damage, personal injury, or expense incurred by the student and arising from the Student’s execution of this agreement, payment processing, and/or participation in any program offered by Allied MMA.
The Student specifically understands and agrees that they are assuming the risk of any and all injuries that they may suffer or incur as a result of their execution of this Agreement and participation in any program offered by Allied MMA.
BILLING AGREEMENT. This agreement is between Allied MMA (Allied) and the Student. Payments (credit card or electronic funds transfer) will be processed by a third-party merchant processor, but all payments to payment schedule, account, method, or amount must be handled between the Student and Allied. All new memberships will be charged a one-time $49 sign-up fee.
CHANGE OR CANCELLATION. If you wish to cancel or change this Agreement the Student must notify Allied by written notice (email or mail). Cancellation requires a 48-hour notification in writing for month- to-month contracts and verbal cancellation will not qualify the Student for a refund. Allied does not prorate charges upon cancellation. You can freeze your contract up to two (2) months with a return date. Term contracts are legally and financially binding. If your account goes unpaid for more than one month, or if you cancel and choose to re-start your membership, you will once again be charged the $49 sign-up fee. Any overdue payment that goes past 5 days will be charged a late fee of $15 and we have a no refund policy.
☐CLASSES AND TUITION. Scheduling and content of classes and programs, furnishing of facilities and provision of instructors to teach and supervise classes and practice sessions are at the sole and absolute discretion of Allied, and can be changed at any time. The Student understand and agrees that additional fees such as uniform and equipment fees may not be included in the price of this Agreement. Allied may raise the tuition rate of ongoing memberships by providing advanced notice equal to the notice period required for cancellation stated herein.
ACCEPTANCE OF MEMBER. By signing this Agreement, the Student agrees to fully and completely comply with all terms and conditions hereof, and Allied’s rules and regulations. Failure to comply with Allied’s rules and regulations is grounds for immediate suspension or termination of services to the Student. Allied reserves the right to use photographs, videotapes, artwork, or other likenesses of the Student for marketing, trade, publishing, or any other lawful purpose.
